These Terms of Service (“Terms”) govern your use of the Oberle Opticians website located at oberle-opticians.optifyweb.com, including any brand or product pages served from associated subdomains (collectively, the “Site”), operated by Oberle Opticians (“Oberle Opticians,” “we,” “us,” or “our”), located at 9552 Harding Ave, Surfside, FL 33154. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. The Site Is a Digital Catalog, Not a Store

The Site is provided as a premium digital catalog of the eyewear brands and collections carried by Oberle Opticians. The Site does not process online orders, payments, or checkout transactions. All purchases, fittings, and eye care services are completed in person at our Surfside, FL location or by contacting us directly. Nothing on the Site constitutes an offer to sell a specific product; it is a presentation of inventory that must be confirmed with our team.

2. Product & Content Accuracy

● Frame availability, pricing, and imagery are provided for informational purposes and are synced periodically from our inventory systems; they may not reflect real-time in-store availability.

● Product images are sourced from our platform's frame catalog and, in some cases, from manufacturer websites. An image may not always depict the exact frame color, finish, or angle available in-store. We work to correct known mismatches as they are identified.

● Product descriptions may be generated with the assistance of AI tools and are reviewed periodically for accuracy; please confirm specifications with our team before visiting or purchasing.

● We reserve the right to correct errors, update information, and change product offerings at any time without notice.

3. Appointments & Concierge Requests

Submitting a contact, concierge, or appointment request through the Site does not guarantee a confirmed appointment time. All appointments are subject to confirmation by our team by phone or email.

4. Intellectual Property

● All content on the Site, including text, graphics, logos, and the Oberle Opticians name and marks, is owned by or licensed to Oberle Opticians and is protected by applicable intellectual property laws, except where noted below.

● Brand names, logos, and product imagery for third-party eyewear brands (including but not limited to Cartier, Maybach, Gernot Lindner, Hoffman, Ahlem, Dior, DITA, Lindberg, Maui Jim, Thom Browne, and other brands featured on the Site) are the trademarks and property of their respective owners and are used to identify genuine products carried by Oberle Opticians.

● You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

5. Acceptable Use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its underlying systems; (c) scrape, harvest, or bulk-collect content from the Site; (d) interfere with the Site's operation or security; or (e) impersonate any person or misrepresent your affiliation with any person or entity.

6. Third-Party Links & Platforms

The Site may link to or embed content from third-party platforms, including Instagram, Facebook, X (Twitter), and YouTube, and is built on the Optify platform. We do not control and are not responsible for the content, policies, or practices of third-party sites.

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS REQUIRED BY LAW. These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and any disputes shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida, unless otherwise required by law.
